Terms of Service

Welcome to KStreak. These Terms of Service ("Terms") govern your use of the KStreak mobile application, web app, and related services (collectively, the "Service") operated by HYTESYSCO LLC ("KStreak", "we", "us", "our").

By creating an account, downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Your account

  • You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
  • You must provide accurate, current information when registering and keep it up to date.
  • You may not share, sell, or transfer your account to anyone else.
  • We reserve the right to suspend or terminate accounts that violate these Terms, applicable law, or that show signs of fraudulent or abusive activity.

3. Acceptable use

You agree not to use the Service to:

  • Post, transmit, or share content that is unlawful, harassing, defamatory, hateful, sexually explicit, or that violates the rights of others.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Reverse-engineer, decompile, scrape, or attempt to extract the source code of the Service, except to the extent expressly permitted by applicable law.
  • Use the Service to develop a competing product, train machine-learning models on Service outputs, or resell access to the Service.
  • Interfere with or disrupt the Service, its servers, or networks (including via denial-of-service attacks, malware, or excessive automated traffic).
  • Access or attempt to access another user's account or data without authorization.
  • Use the Service for any purpose that violates applicable law or regulation.

4. Your content

  • You retain ownership of the content you create in the Service (notes, journals, voice recordings, goals, tasks, decisions, knowledge graphs, messages, etc.) ("Your Content").
  • You grant KStreak a limited, worldwide, royalty-free license to host, store, transmit, display, and process Your Content solely for the purpose of providing and improving the Service to you.
  • You represent that you have the rights to all content you upload and that it does not infringe on any third party's intellectual-property, privacy, or other rights.
  • We do not claim ownership of Your Content. You can delete Your Content (or your entire account) at any time per our Privacy Policy and our account-deletion process.

5. AI features and KStreak Coach

  • Some Service features use large-language-model providers (OpenAI, Anthropic, Google Gemini) routed through our Emergent LLM gateway. When you use AI features, the relevant text from Your Content is sent to the provider for processing and the result is returned to you.
  • AI output is generated automatically and may be inaccurate, incomplete, or out of date. You are responsible for verifying any AI output before relying on it — particularly for medical, legal, financial, or safety-critical decisions. KStreak does not provide medical, legal, or financial advice.
  • We do not allow our AI providers to train on Your Content. See the Privacy Policy for details.
  • KStreak Coach is a productivity and reflection assistant, not a substitute for a licensed therapist, doctor, or financial advisor. If you are in crisis or experiencing a mental-health emergency, contact your local emergency services or a crisis line immediately.

6. KStreak Pro & subscriptions

  • Some Service features require a paid subscription ("KStreak Pro"). Pricing, included features, and billing frequency are shown in-app before you subscribe.
  • Mobile subscriptions are billed by Apple App Store (iOS) or Google Play Billing (Android). Web subscriptions are billed by Stripe. KStreak does not see or store your full payment-card details.
  • Subscriptions renew automatically until you cancel. You can cancel at any time through your App Store account (iOS), Play Store subscriptions (Android), or your KStreak account page (web). Cancellation takes effect at the end of the current billing period; you keep Pro access until then.
  • Refunds: refund eligibility is governed by the policies of the platform that processed your payment (App Store, Play Store, or Stripe). KStreak does not process refunds directly except where required by law.
  • If we materially change pricing or what's included in KStreak Pro, we will notify you at least 30 days before the change takes effect.

7. Privacy

Your privacy is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to the data practices described there.

8. Termination

  • You can stop using the Service or delete your account at any time using the account-deletion process.
  • We may suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms, applicable law, or to protect the Service and our users.
  • Sections that by their nature should survive termination (including Sections 4 last paragraph, 9, 10, 11, 12, 13) will survive.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

KStreak does not warrant that AI-generated output is accurate or fit for any particular purpose. You use AI features at your own risk.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KSTREAK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) $100 USD.

Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless KStreak and its affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from (a) Your Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any third party's rights or applicable law.

12. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-laws principles. You agree that any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in the Commonwealth of Virginia, except where prohibited by applicable law.

Nothing in these Terms prevents you from filing a complaint with a government agency or pursuing rights under consumer-protection laws that apply where you live.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above and — if the changes are material — notify you in-app or by email. Your continued use of the Service after the change takes effect constitutes acceptance of the revised Terms.
